Intellectual Property Rights

Introduction


Intellectual property rights (IPR) are rights given to people to protect commercially valuable products of human intellect, similar to the rights in the forms of physical property. IPR are necessary to protect product or services from being copied or stolen by others. IPR cover human intellect creations, such as inventions, designs, trademarks or artistic works (music, books, films, dances, sculptures or photographs).
 

This resource guide, prepared by the library staff aims to list useful sources of information on the subject,which are available in JGU Library and elsewhere, both in print and electronic forms. It also includes important links to useful free & open access web resources.

Intellectual property the law of copyrights, patents and trademarks, By Schechter, Roger E. & Thomas, John R. This work provides a comprehensive treatment of all the three major branches of Intellectual Property law- Copyrights, Patents and Trademarks.  The whole work divided into three principal parts dealing with three branches of the IP law. There are cross-references in both text and notes, to alert the reader to overlap or even conflict between the various branches of Intellectual Property Law.

Introduction

IPR cover human intellect creations, such as inventions, designs, trademarks or artistic works, such as music, books, films, dances, sculptures or photographs.

Nimmer on copyright, By Nimmer, Melville B. & Nimmer, David. :  This 11 vol. set looks at modern US copyright law and how it affects printed works, plays and motion pictures, computer software and chips, and artistic property. World copyright law, By Sterling, J. A. L. : This work covers protection of copyrights on a national, international and regional basis and also technological protection to copyright material. Overall this is a complete work of copyright which explains every aspects of international copyright issues and polices.

Copinger and Skone Jams on Copyright : This 2 vol. set provides coverages and analysis of legislation and law on copyrights of United States. It covers every aspects of copyrights form nature, origin and history to the present complicated cases of the copyright. The multidimensional nature of the copyright and its treatment in different phase of law is the main point of discussion.

Ed. By, F. Scott Kieff [et. Al] Principles of patent law : cases and materials: Using case studies, case notes, examples, and problems to illustrate points under consideration, this casebook presents the patent law process sequentially, highlighting the legal history and discussing the intricacies of law and technology. Covering such topics as obtaining a patent, utility, infringement, and remedies, recognized authorities provide expert commentary and advice from the viewpoint of both attorney and judge.

Attorney's dictionary of patent claims, on 3 vol. set,  By Aisenberg, Irwin M. : This work is primarily directed to applications for letters patent before the United States Patent and Trademark Office. The purpose of this work is to make accessible to all practitioners what is available through a review of Official Gazetteers.

 

 

Reference Books on Trademarks.

 

Law of trademarks and geographical indications law, practice & procedure, By Kailasam, K. C., Vedaraman, Ramu, and Viswanathan, T. K. :  This book contains an exhaustive and analytical commentary on the Trade Marks Act, 1999, The Trade Marks Rules, 2002, statutory order along with a full collection of statutes, rules, forms, precedents, Geographical Indications Acts, rules and guidelines, international treaties and conventions, TRIPS agreement, NICE agreement, MADRID agreement, UK trade Marks act, misleading and comparative advertising directives and regulations and full text of the international classification  of goods and services for the purposes of the registration of marks-alphabetical list etc.

Gilson on trademarks, By Lalonde, Anne Gilson, Green, Karin, and Gilson, Jerome.  : 10 vol. set is the outcomes of the surveys of the law of trademarks in the United States and provides practical suggestion for the trademark practitioner. The first three volumes are full of case analysis and practice tips on issues on trademark clearance, infringement, counterfeiting etc. Volume 4 & 5 contains forms required in the day-to-day practice of trademark law. Volume 6 includes Lanham Act and USPTO’s trademarks rules and practices, exam guides etc. Legislative history of the Trademark Law in USA and valuable reference guides covers last three volumes.

Trademark protection and practice: trademark trial and appeal board manual of procedure, By Gilson, Jerome and Lalonde, Anne Gilson. : The purpose of his manual is to provide basic and useful information to practitioners for litigating cases before Trademark Trial and Appeal Board. The manual does not modify, amended or serve as a substitute for any existing statues, rules or decisional law and is not binding upon the Board.

Olsen, John R and Maniatis, Spyros M. -Trade marks, trade names and unfair competitions: world law and practice : This is a guide book to the law and practice of trademark applications, registration and enforcement in some 200 jurisdictions worldwide. The work includes: explanation of the legislation, descriptions of the procedure for trade mark registration and protection, and what to do to challenge infringement and seek redress, coverage of trade names and unfair competition, at-a-glance table showing over 30 key aspects of trade mark law and practice for each country, a new section on domain names etc.

Intellectual Property Articles and Books : By Adam Daniel Moor, Department of Philosophy and Information School, University of Washington, 2001, 2004, This is a good collections of IPR books of United States as well as international intellectual property law concern.

International Intellectual Property Law, by Jonathan Franklin, American Society of International Law, is more a guide book than a bibliography. You will benefited to find things on international intellectual property law like,  treaties, organizations, societies, agreements on international intellectual property, books on IPR, seminar proceedings and lot more.

Specialized Bibliographies: Intellectual Property: USA embassy, Panama, this is a beautiful work of more than 25 books with its bibliographical information along with special notes specifying the importance of the book.

 

E-books:

The popularity of a digital book or electronic version of a traditional printed book is growing rapidly due to it’s multidimensional futures and rapidly growing technologies to support to reading it. The Global Library has some good collection of e-books in different subjects in its different collection sources. University of Illinois Journal of Law, Technology and Policy, published bi-annually by University of Illinois College of Law. The Journal focuses on issues on law, technology, and policy on the topics from intellectual property, information technology, biotechnology, cybersecurity, telecommunications, patent law and privacy. Full text is available from 2001 onwards in Heinonline.

APLA Quarterly Journal, published quarterly by American Intellectual Property Law Association. The Journal is dedicated to presenting materials relating to intellectual property matters. Full text is available from volume 1-40 in Heinonline.

Journal of the Patent and Trademark Office Society, published quarterly by The Patent and Trademark Society. A peer reviewed journal is a medium of expression for the exchange of thought in the fields of Patents, Trademarks, and Copyrights. Journal of Copyright Society of the USA, formerly known as the Bulletin of the Copyright Society of the USA is exclusively devoted to the subject of copyright law. Full text is available from  Volume 1 (1953) onwards in Heinonline)

The Trademark Reporter, Published bi-monthly by International Trademark Association is dedicated solely to trademark law and related topics. The Annual Reviews of U.S. and International Law are highlights of each publishing year. Full text  is available from Volume 1 (1911) onwards in Heinonline)

Intellectual Property Quarterly (UK). Published quarterly by Sweet & Maxwell generally discusses policy issues in intellectual property law and their effects in industry. High proportion of international coverage, focusing particularly on common law jurisdiction. Full text is available from 1997 onwards in Westlaw.

International Review of Intellectual Property and Competition Law, (IIC), publishes two issues in every quarter by Springer, tracks worldwide developments in intellectual property and competition law, presenting the finest academic research in these fields from a European legal perspective. Full text is available from 1993 onwards in Westlaw

Journal of World Intellectual Property, published bi-monthly by John Wily and Sons Ltd. It discusses in depth all TRIPS-related developments, the decisions on TRIPS rendered by the WTO Dispute Settlement Body, and the efforts made by each country to adjust their legislation to TRIPS requirements (Not subscribed by JGU library)

European Intellectual Property Review, published monthly by Sweet & Maxwell, provides comprehensive coverage and analysis of new developments and crucial litigation in the field of intellectual property rights. Full text is available form 1986 onwards in Westlaw.

Information & Communications Technology Law, published thrice in a year by Routledge. It covers topics such as: the implications of IT for legal processes and legal decision-making, computer misuse and related policing issues, intellectual property rights in algorithms, chips, databases, software etc.,  IT and competition law; data protection; freedom of information; the nature of privacy, legal controls in the dissemination of pornographic, racist and defamatory material on the Internet; network policing; regulation of the IT industry; problems of computer representation and the computational semantics of law (Not subscribed by JGU library)

 

Indian Journals in IPR
Among the prominent journals published from India on the subject, followings are some of them. The JGU Library subscribes some journals as mentioned below.

Journal of intellectual property rights, published bi-monthly by CSIR-NISCAIR. The main objective of the journal is to enhance communication between policy makers, organizational agents, academics, and managers on the critical understanding and research on intellectual property.  It is a complete open access journal and print issues available in JGU library form 2012 onwards.

Indian Journal of Intellectual Property Law, published annually by NALSAR University of Law, Hyderabad from 2008 onwards. The journal is as a forum for the expression of ideas on intellectual property law by students across the country. The journals is available in our library from 2008-2012 in Westlaw.

 

Indian Journal of Law and Technology, published annually by the National Law School of India University, Bangalore. The journal discusses the domestic and international issues pertaining to the growing interface between law and technology. It is available in JGU library from 2005 onwards in Westlaw.

 

Intellectual Property Review, published by Centre for Intellectual Property Research and Advocacy (CIPRA), National Law School of India University (NLSIU), Bangalore. The journal publishes various aspects relating to intellectual property law with special reference to advances made in the Indian and international framework.

 

NLIU Journal of Intellectual Property Law, The journal, published annually by The National Law Institute University, Bhopal. Its aim to help build a fair and equitable regime of Intellectual Property Law and to study the dynamic confluence of the academic and the transactional world presented by the Intellectual Property Laws.

Fordham Intellectual Property, Media and Entertainment Law Journal : Published by Fordham University School of Law USA, covers areas of intellectual property law including patent and copyright law, Internet law, first amendment rights, and mass media law.

Duplicity, by Gilory, Tony : available in JGU library, narrates the story of a revolutionary industrial product and the patent war with two rivalry organization. This is a good example to work together, using the corporate rivalry to their advantage, they would have to trust one another - difficult, if not impossible.

The social network, by Fincher, David, available in JGU library, is a biographical drama of Mark Zuckerberg and the success story of Facebook. It witnesses the threats that Zuckerberg faced at the hands of two brothers who sued him for apparently stealing their idea, his former college friend who funded his project, and the founder of Napster who spread the word about Facebook.

The Spanish Prisoner, by Scott, Campbell, a david Mamet film, available in JGU library, is all about the new invention and the problem to use them in this IPR complicated society. Trade Mark Act, 1999 : The Trade Marks Registry was established in India in 1940 and presently it administers the Trade Marks Act, 1999 and the rules thereunder. It acts as a resource and information Centre and is a facilitator in matters relating to trade marks in the country. International Conventions

TRIPS : The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) is an international agreement administered by the WTO in 1994. TRIPS agreement is a most comprehensive agreement in intellectual property law and it first time introduced Intellectual Property law in to an international trading system. India is a signatory in this treaty.

Paris Convention for the protection of Industrial Property : The treaty signed in Paris, France, on 1883, was one of the first intellectual property treaties. It established a Union for the protection of industrial property. The Convention is still in force as of 2014. India is one of the signatory country in this convention.

Borne Convention for the Protection of Literary and Artistic Work : Usually known as Borne Convention is an international agreement governing Copyright was first accepted in Borne, Switzerland, in 1886. It requires its signatories to recognize Copyrights of works of authors from its member countries and its own nations.

Patent Cooperation Treaty (PCT) 1970. The Treaty makes it possible to seek patent protection by filing an "international" patent application.

IPAB, Intellectual Property Appellate Board, constituted by Gazette notification of central government of India in 2003 having its headquarter at Chennai. It hears the appeals pending before various high courts in India before 2003 and the new and fresh appeals under the Patent Act. 1970.
