International Human Rights Law

Introduction to Human Rights Law



Human Rights are fundamental rights, obligations or principles and these are inalienable to all persons, whatever their caste, class, race. Age, gender, language, nationality, religion or belief, simply because are human being. Each person entitled equally to human rights without any discrimination. Human rights considered as universal rights which includes right to life, freedom, education and economic, social and cultural rights as well.


International Human Rights Law is a part of International Law which is aimed to support & protect human rights at international, regional and domestic levels. International Human Rights Law are expressed by international treaties & agreements between states; customary international law (evidence of a general practice accepted as law); general principles and other source of international law. The Universal Declaration of Human Rights adopted by United Nation in 1948, contains basic human rights of all people regardless of race, religion, place of residence or gender.

International Committee of Red Cross (ICRC)

  • ICRC - Geneva Conventions introducing Geneva treaties or Conventions and their additional Protocols form the core of international humanitarian law which regulates the conduct of armed conflict and seeks to limit its effects. They protect people not taking part in hostilities and those who are no longer doing so.
  • ICRC International Humanitarian Law: Treaty Database and States Party provides information on treaties and other instruments related to International Humanitarian Law, treaty status, and State parties to the treaties.

European Union

International Labour Organization

  • NORMLEX produced by the International Labour Organization (ILO) an information system which brings together information on International Labor Standards (such as ratification information, reporting requirements, comments of the ILO's supervisory bodies, etc.) as well as national labor and social security laws.
  • LABORDOC produced by the International Labour Organization (ILO). 1965- a bibliographic database with worldwide coverage of economic policy; employment; labor legislation, policy, relations, management; rural development, and working conditions. It covers all aspects of work and sustainable livelihoods and the work-related aspects of economic and social development, human rights and technological change.

United Nations provides useful information of human rights including related information and links to UN bodies; thematic issues related to violence against women & children, sexual violence, genocide, armed conflict, human trafficking, lesson from Rwanda, indigenous peoples etc.; UN past conferences on Human rights.

  • United Nations High Commissioner for Human Rights (UNCHR) works to promote and protect the human rights that are guaranteed under international law and stipulated in the Universal Declaration of Human Rights of 1948. the portal provide following information:
    • Human rights by Countries provides access to treaties, state reports, comments, and most other documentation related to human rights
    • Lists all OHCHR Human Rights Bodies i.e. Charter-based bodies include the former Commission on Human Rights, the Human Rights Council, and Special Procedures and Treaty-based bodies.
    • Publications includes fact sheets; special issues; reference; training & education  and policy & methodological materials that provides information to Governments, national institutions, civil society, the general public and the media.  
    • Documents portal convenient source for categories of U.N. documents, including resolutions of the General Assembly, Economic and Social Council, and Security Council.
    • UN Treaty Collection
  • UN High Commissioner for Refugees (UNHCR) protect asylum-seekers, children, internally displaced people, older people, people with disabilities, returnees, stateless people, women and refugees and resolve their problems worldwide. UNHCR operate in some 125 countries around the world including Africa, America, Asia and the Pacific, Europe, Middle East and North African countries. UNHCR provides following information source related to human rights:
    • RefWorld is a source of information on refugee status. It contains a vast collection of reports and information relating to situations in countries of origin, policy documents and positions, and documents relating to international and national legal frameworks.
    • International Human Rights Treaty Bodies by Office of the High Commissioner for Human Rights (OHCHR), there are ten human rights treaty bodies that monitor implementation of the core international human rights treaties.
    • Information resources lists archives & records hold material from decades of operations, including electronic documents; wide range of publish materials, including The Global Appeal and Global Report; statistics and operational data.
  • International Labour Organization (ILO) founded in 1919 is the first specialized agency of the UN in 1946 for labour issues, particularly international labour standards. ILO promotes rights at work, encourage decent employment opportunities, enhance social protection and strengthen dialogue on work-related issues.

 

Council of Europe founded in 1949 as an advisory international organization which promote co-operation between European countries in the areas of legal standards, human rights, democratic development, the rule of law and cultural co-operation.

  • Council of Europe Human Rights Portal protect and promotes human rights through international conventions, such as the Convention on Preventing and Combating Violence against Women and Domestic Violence and the Convention on Cybercrime. It includes treaties, such as the European Convention on Human Rights.
    • HUDOC database (European Court of Human Rights) provides access to the case-law of the European Court of Human Rights (Grand Chamber, Chamber and Committee judgments, decisions, communicated cases, advisory opinions and legal summaries from the Case-Law Information Note), the European Commission of Human Rights (decisions and reports) and the Committee of Ministers (resolutions).
  • Organization for Security and Co-operation in Europe  is the world's largest security-oriented intergovernmental organization. Its mandate includes issues such as arms control and the promotion of human rights, freedom of the press and fair elections and concerned with early warning, conflict prevention, crisis management, and post-conflict rehabilitation.
    • OSCE Resources lists Publications of annual reports, books, factsheet, guide, manual, handbook, periodicals and study reports; Official Documents of conferences & meetings, legal, treaty & agreements, and reports.
  • European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) is the anti-torture committee of the Council of Europe which highlights two important features: first, it is European in coverage, and second, it not only covers “torture”, but also a whole range of situations which could amount to “inhuman or degrading treatment or punishment”.
    • CPT Documents lists country reports, standards, annual general reports, reference & working documents, and conference proceedings.
    • HUDOC CPT database includes reports,  public statements, and "standards" from the CPT.

 

 

  • African Union
    • African Commission on Human and Peoples’ Rights is a quasi-judicial body tasked with promoting and protecting human rights and collective (peoples') rights throughout the African continent as well as interpreting the African Charter on Human and Peoples' Rights and considering individual complaints of violations of the Charter. It includes relevant treaties and legislation, as well as state reports, information on reservations, declarations, legal instruments, and other documents.

 

 

Global and Non-Governmental Organizations (NGO)


  • Amnesty International  is a non-governmental organization focused on human rights with over 7 million members and supporters in over 150 countries and territories who campaign to end abuses of human rights. It conducts research and generates action to prevent and end grave abuses of human rights, and to demand justice for those whose rights have been violated.   • International Committee of the Red Cross  is a humanitarian organization which protects the lives and dignity of victims of armed conflict and other situations of violence and to provide them with assistance and also endeavors to prevent suffering by promoting and strengthening humanitarian law and universal humanitarian principles.
  • Human Rights Watch is a non-profit, independent and international organization which defends the rights of people.
  • Asian Human Rights Commission is an independent & non-governmental body, promoted by a prominent group of jurists and human rights activist in Asia. The main objective of this commission is to promote awareness and realization of human rights in the Asian region, and mobilize Asian and international public opinion to obtain relief and redress for the victims of human rights violations.

International Courts and Tribunals


  • European Court of Human Rights (ECHR) is an international court, established by the European Convention on Human Rights. It hears applications alleging that a contracting state has breached one or more of the human rights provisions concerning civil and political rights set out in the Convention and its protocols. An application can be lodged by an individual, a group of individuals or one or more of the other contracting states, and, besides judgments, the Court can also issue advisory opinions.
  • The African Court on Human and People's Rights (ACHPR) is a continental court established by African countries to ensure protection of human and peoples’ rights in Africa. It complements and reinforces the functions of the African Commission on Human and Peoples' Rights.
  • International Court of Justice (ICJ) (accessed March 10, 2015) lists all ICJ cases & judgments since 1946, along with ICJ publications (1946 onwards) including Judgments, Advisory Opinions and Orders; Acts and Documents; Yearbook; and Bibliography. Beside 1946 onwards publications, there is a collection of Permanent Court of International Justice (1922-1946) publications consisting decisions from 1922 to 1940; judgments and Advisory Opinions given by the Court until 1930; Pleadings, Oral Arguments, Documents from 1931; Court’s Yearbooks from 1922-1946; and Court’s publications catalogues.

  • ASIL Guide to Electronic International Law Resources: International Human Rights Law  provides judges and courts from around the world with educational programming, opportunities for transnational networking, resources, and tools for understanding an increasingly internationalized legal landscape and for effectively using international law when it arises in the courts.
  • Electronic Information System for International Law (EISIL) highlights important instruments and web resources for researching various topics within human rights as well as the different regional systems.  
  • Project Diana - Women's Human Rights Resources Database (University of Toronto) lists hundreds of resources -articles, documents and links -- related to international women's rights law and Canadian women's rights law.
  • Yale University, Cambodian Genocide Program (1994-2015) the Cambodian genocide, a  serious crimes committed during the Khmer Rouge regime (1975-1979 in which approximately 1.7 million people lost their lives (21% of the country's population), was one of the worst human tragedies of the last century. Cambodian Genocide Program, a project of the Genocide Studies Program at Yale University's has been studying these events to learn as much as possible about the tragedy, and to help determine who was responsible for the crimes of the Pol Pot regime.
